explains how we collect, use, disclose, and otherwise process personal information in connection with our
services. This Privacy Notice is not, however, a contract and does not create any legal rights or
obligations.

One Night: One Night, Inc. is headquartered in the United States with operations in the European Economic Area, Canada, and other locations around the world. When we use the terms "One Night", "we", "us", or "our" in this Privacy Notice, we are referring to One Night, Inc. and its subsidiaries and affiliated companies.

Our Services: When we use the term "services", we are referring to all the services that we offer on our own behalf, including our product offerings and the websites and mobile applications that post or link to this Notice.

Region-Specific Disclosures

We may choose or be required by law to provide different or additional disclosures relating to the processing of personal information about residents of certain countries, regions or states. Please refer below for disclosures that may be applicable to you:

What is Personal Information?

When we use the term “personal information” in this Privacy Notice, we mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to you. It does not include aggregated or anonymized information that is maintained in a form that is not capable of being associated with or reasonably linked to you.

 

Our Collection of Personal Information

From the first moment you interact with us, we are collecting personal information about you. Sometimes we collect personal information automatically when you interact with our services and sometimes we collect the personal information directly from you. At times, we may collect personal information about you from other sources and third parties, even before our first direct interaction.

Personal Information You Provide

We collect the following personal information you provide in connection with our services, depending on your relationship with us, as follows: 

  • Contact information. We may receive information such as your name, username, email address, postal address, title, occupation, city of birth, hometown, relationship status, telephone number, password, social media account handles, and billing information when you communicate with us through the services, contact Customer Service, create an account  to join our service, make a hotel booking, sign up to our marketing emails, enter a contest or sweepstakes, respond to a survey, apply to serve as an agent or hotel, or otherwise communicate with us. We may also collect any communications between you and us and any other information you provide to One Night. 

  • Comments, suggestion, chat and opinions. When you contact us directly, e.g. by email, phone, mail or by completing an online form or participating in online chat, we will record your comments and opinions. We will also record comments and opinions you express when responding to surveys, entering a sweepstakes or taking part in promotions we run. 

  • Payment and Transaction information. When you book a hotel through Us, we partner with third party payment services to process payments made through the services. While our payment services receive payment information and other necessary billing information, we only receive order details, and order preferences such as hotels booked, services purchased, and date and time of your transaction. 

  • Demographic Information. We may collect information such as your gender, income, marital status, employment status, or political preference when you complete one of our surveys or update your account profile information. 

  • User Content and Interactions through the Services. We collect information about how you use the services, your actions on the services, and content you post to the services, including photos and videos you post to the services, application questionnaire and biography, comments on blog posts or reviews of our products, hotel recommendations, reasons for booking a hotel, and any content you provide through emails, in-app messages, chat, or other functionality (“User Content”). To share photos and video, we will access your device camera roll and camera with your permission.  If you need to update your permissions, you can do so in the "Settings" app of your device. Please remember that One Night may, but has no obligation to, monitor, record, and store User Content in order to protect your safety or the safety of other users, to assist with regulatory or law enforcement efforts, or to protect and defend our rights and property. By using the services, you consent to the recording, storage and disclosure of such communications you send or receive for these purposes.   

 

Personal Information Automatically Collected

As is true of most digital platforms, we collect certain personal information automatically when you visit our online services, including:

  • Geolocation Information. We may collect information about your location with varying degrees of accuracy through GPS/GNSS, WiFi, Bluetooth Low Energy, wireless network triangulation or other methods in order to obtain your location for the purposes of providing our services. We may also approximate your location by your IP Address. 

 

We may also use the Google Maps API to gather information about your location. Google uses various technologies to determine your location, including IP address, GPs and other sensors that may, for example, provide Google with information on nearby devices, WiFi access points and cell towers (see Google Maps privacy policy to learn more).

 

We maintain location information only so long as is reasonable to provide the services and then delete location data tied to your personal information. We may maintain de-identified and anonymized location data for a longer period of time in order to analyze aggregate trends and metrics. 

  • Log Files. We record certain information in a log file every time your browser or user-agent requests any information from our server, such as your device's operating system, application software, Internet Protocol (IP) address, access times, crash reports, browser type and language, peripherals, user log data, Active Directory information, and the websites you visited before and after our online services. 

  • Inferences. Through the use of our services, we may collect information such as your hotel booking history, conversion rates (if you are a One Night Agent), number of times you viewed one of the offered hotels, or hotels you place in our shopping cart.

Personal Information from Other Sources and Third Parties

We also obtain personal information from other sources, which we often combine with personal information we collect either automatically or directly from you. We collect your personal information from other sources as follows: 

  • Referrals:  We may offer a referral service that allows you to tell one of your friends about our services by forwarding certain marketing communications and/or emails or links to an individual you believe may be interested in our products and services.  If we do offer such a service, we will use personal information collected in connection with these referral services to communicate with the individual you are referring and to provide you any benefits, incentives and/or rewards you may be eligible for as a result of your referral. 

  • Business Partners: Our business partners, such as our partner hotels, collect personal information in connection with our services and often share some or all of this information with us.  For example, we receive information about transactions you complete on our business partners’ websites through our services in order to count those transactions toward any booking fees or programs Agents or Guests may be participating in as part of the services.  

  • Service Providers: Our service providers, such as payment processors and marketing providers, collect personal information and often share some or all of this information with us.  For example, we receive personal information from payment processors to confirm that your payment for the services was accepted. 

  • Other One Night Entities.  We may receive information about you from other One Night companies, businesses, brands and affiliated entities in our family of companies, so that information you provide to one brand may be used by another brand to provide you services or to communicate with you.     

  • Social Media: If you choose to interact with us on social media, we may collect personal information about you from your social media account that you make public.  We use personal information collected in connection with your social media account to communicate with you, better understand your interests and preferences, and better understand our customer base in the aggregate. 

  • Authentication Services You Connect to our Service. Some parts of our services may allow you to login through a third party social network or authentication service such as Facebook. These services will authenticate your identity and provide you the option to share certain personal information with us, which could include your name, profile picture, email address, or other information. The data we receive is dependent on that third party’s policies and your privacy settings on that third party site.

  • Inquiry Information:  If you choose to contact us, we will collect personal information in connection with your inquiry and correspondence with us.  We may need additional information to fulfill your request or respond to your inquiry. We may provide additional privacy disclosures where the scope of the inquiry/request and/or personal information we require fall outside the scope of this Privacy Notice.  In that case, the additional privacy disclosures will govern how we may process the information you provide at that time. 

 

Our Use of Personal Information

We use personal information we collect to: 

  • Create, authenticate, and administer your account; process your bookings and credit requests, deliver our products and services; communicate with you directly about the One Night services, including hotel bookings, and about any questions, issues or concerns you or other users have. 

  • Provide you with products or services that you request or in which you express interest; to improve, market or promote One Night’s products and services; to inform our marketing and advertising campaigns, and customize the advertising and content you see; to alert you to product upgrades, special offers, upcoming events, updated information and other new products and services offered by One Night or our third party partners; or to display advertisements, including advertisements from third parties. 

  • Facilitate contests, sweepstakes, promotions and rewards, enroll you in loyalty programs, or conduct surveys. 

  • Provide customer service or feedback; respond to employment opportunities for which you’ve applied; 

  • Measure our performance and improve our products, services and customer experience.

  • Develop, create, enhance, improve, optimize, and maintain our Services. 

  • Operate, maintain, test, enhance, update, monitor, diagnose, fix and improve our services and products.

  • Detect, prevent, investigate or provide notice of fraud or unlawful or criminal activity;

  • Enforce and carry out contracts and agreements; and 

  • Comply with legal obligations. 

 

Our Disclosure of Personal Information

We disclose personal information in the following ways: 

  • Within One Night. When you provide personal information to one of our One Night brands, we may share that information with other companies and brands owned or controlled by One Night, Inc., including but not limited to One Night, and other companies owned by or under common ownership as One Night, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns.  These companies will use your personal information in the same way as we can under this Privacy Notice;

  • Business Partners. We share personal information with third parties with whom we do business and who may offer their services through the One Night services. These businesses may use that information for their marketing and business purposes, including without limitation, to inform and improve third-party advertising.  For example, we may provide personal information relating to your account or your use of the services to the relevant business partner when you make a hotel booking.  

  • Payment Processors and Online Payment Systems. We share personal information with payment processors, online payment system providers and other billing agents to process your payments when, for example, you make a hotel booking. 

  • Data Analytics Providers. We share personal information with data analytics providers who analyze statistics and trends relating to the usage of and activity relating to our services.  These data analytics providers produce reports and make suggestions for our customer and business strategy based on the personal information and other information analyzed.  

  • Marketing Partners:  We coordinate and share personal information with our marketing partners, including advertisement networks, social networks, retargeting partners and marketing communication providers, in order to communicate with you about our products and services and market our products and services to you.  We may also share aggregated demographic information with third parties interested in advertising on our online services to assist them in understanding the audience they would be reaching, but this information is not designed to be identifiable to a specific individual.

  • Customer Service and Communication Providers:  We share personal information with third parties who assist us in providing our customer service experience and facilitating our communications with you, including third parties that provide call center, email and chat support services. 

  • Other Service Providers:  In addition to the third parties identified above, we engage other third parties to perform certain functions on our behalf in connection with the uses of personal information described in the Our Collection and Use of Personal Information section above, including communication printing, website hosting, information technology support, content development and fraud monitoring.  Depending on the function the third party serves, the service provider may process personal information on our behalf or have access to personal information while performing functions on our behalf. 

  • Public Disclosure:  We may disclose certain personal information about you publicly through our services, such as your username, first name/initial, last name, occupation, hometown, city of residence, relationship status, and photo as part of your biography and/or to identify you as a user of our service. 

  • Business Transaction or Reorganization: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of One Night assets. We may disclose personal information to a third party during negotiation of, in connection with or as an asset in such a corporate business transaction. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership. You will be notified by email and/or a prominent notice on any affected online service of any change in ownership, as well as any choices you may have regarding your personal information as a result of the transaction. 

  • Legal Obligations and Rights:  We may disclose personal information to third parties, such as legal advisors and law enforcement: 

    • in connection with the establishment, exercise, or defense of legal claims; 

    • to comply with laws or to respond to lawful requests and legal process; 

    • to protect the rights and property of us, our agents, customers, and others, including to enforce our agreements, policies, and terms of use;

    • to detect, suppress, or prevent fraud; 

    • to reduce credit risk and collect debts owed to us; 

    • to protect the health and safety of us, our customers, or any person; or 

    • as otherwise required by applicable law.

  • Consent:  We may disclose personal information about you to certain other third parties with your consent. 

 

Your Communication Preferences 

In connection with our services, we may send you email messages, direct mail offers, SMS messages, push notifications or other communications, including telephone calls, regarding our services.  You may ask us not to send you marketing communications or request a change to the method or frequency of communication by:  

  • Following any available opt-out or communication preferences instructions in the marketing communications; 

  • When available, accessing the “Unsubscribe” or “Communication Preferences” settings in your account profile page;

Please allow up to 10 days for your request to be processed.  If you request to opt out of marketing communications, please note that we may continue to send you non-marketing communications, such as those directly related to the fulfillment of a specific transaction you requested, maintenance of your account or status of our ongoing business relations.

 

Your California Privacy Rights

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year. Children’s Personal Information

Our websites and online services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. If you are under the age of 13, please do not use our websites or online services or otherwise provide us with any personal information either directly or by other means. If a child under the age of 13 has provided personal information to us, we encourage the child’s parent or guardian to contact us to request that we remove the personal information from our systems. If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information.

 

Security of Personal Information

We care about the security of your information and employ physical, administrative, and technological safeguards designed to preserve the integrity and security of all information collected through our website.  However, no security system is impenetrable, and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

 

Third-Party Websites

Our websites and online services may include links to third-party websites, plug-ins and applications. Except where we post, link to or expressly adopt or refer to this Privacy Notice, this Privacy Notice does not apply to, and we are not responsible for, any personal information practices of third-party websites and online services or the practices of other third parties. Updates to This Privacy Notice

We will update this Privacy Notice from time to time. When we make changes to this Privacy Notice, we will change the "Last Updated" date at the beginning of this Privacy Notice. If we make material changes to this Privacy Notice, we will notify you by email to your registered email address, by prominent posting on this website or our online services, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided in the notification.

Additional EEA Privacy Disclosures

Unless otherwise expressly stated, capitalized terms in these Disclosures have the same meaning as defined in the Privacy Notice.  

 

Scope of Disclosures

These Additional European Economic Area (EEA) Privacy Disclosures supplement the information contained in our Privacy Notice, but unlike the Privacy Notice, these Disclosures apply only to our processing of your personal data where you are based in the EEA. 

 

One Night, Inc. is the data controller responsible for the collection and use of such personal data.  

 

Personal Data Disclosures

When we use the term “personal data” in these Disclosures, we mean any information relating to an identified or identifiable natural person.

 

Legal Bases for Processing

We rely on the following legal grounds to process Personal Data about you, whether it is obtained from you or a third party:

  • Basic personal details, contact and account information. Such as your name, mobile number, age, city of birth, hometown, account password and email address.

    • ​We use this information to allow you to register for an account on the services. The processing is necessary for the performance of a contract and to take steps prior to entering into a contract (namely the Terms of Use).

    • We use this information to provide to you the features and functionality of the services. The processing is necessary for the performance of a contract and to take steps prior to entering into a contract (namely the Terms of Use).

    • We use this information to send you service-related emails and messages (for example, account verification, updates to features of the services, technical and security notices). This processing is necessary for our legitimate interests, namely, administering the service and communicating with you in connection with the service.

    • We use this information to send you promotional messages, including email messages and push notifications, from us and from our partners. We will only process your personal information in this way to the extent you have given us consent to do so.

  • Profile information. This is information you choose to put in your profile such as photo, name, username, contact information (for example email, phone number or mailing address), and links to social media accounts.

    • ​We use this information to allow you to populate your profile with relevant information. The processing is necessary for the performance of a contract and to take steps prior to entering into a contract (namely the Terms of Use).

    • We use this information to provide to you the features and functionality of the services. The processing is necessary for the performance of a contract and to take steps prior to entering into a contract (namely the Terms of Use).​​

  • Information collected from other sources. We may receive information about you from third parties and other users.

  • Information received from social networks. If you interact with the services through a social network, we may receive information from the social network such as your name, profile information, and any other information you permit the social network to share with third parties. The data we receive is dependent on your privacy settings with the social networks.

    • ​We use this information to authenticate you and allow you to access the Service, as well as to populate your profile with your contact information (such as your name and email address). The processing is necessary for the performance of a contract and to take steps prior to entering into a contract (namely the Terms of Use).

    • ​We work with a payment processor and use this information to facilitate transactions where you make a hotel booking or purchase other services. The processing is necessary for the performance of a contract and to take steps prior to entering into a contract (namely the Terms of Use).

  • Comments, chat and opinions. When you contact us directly, for example, by email, phone, mail or by completing an online form or participating in online chat, we will record your comments and opinions.

    • ​To address your questions, issues and concerns and resolve your customer service issues. The processing is necessary for our legitimate interests, namely communicating with you effectively for the purposes of resolving your issues.

We also automatically collect personal information about you indirectly about how you access and use the services and information about the device you use to access the services. The section below sets out the categories of personal information collected about you automatically and how we use that information. The table also lists the legal basis which we rely on to process the personal information.

  • Information about your device and its software, such as your IP address, browser type, Internet service provider, device type/model/manufacturer, operating system, date and time stamp, and a unique ID that allows us to uniquely identify your browser, mobile device, or your account (including, for example, a persistent device identifier, IDFA or Google AdID), and other such information. We may also work with third-party partners to employ technologies, including the application of statistical modelling tools, which permit us to recognize and contact you across multiple devices.

    • ​We use this information to present the services to you on your device and to enhance and personalize your experience using the Service. The processing is necessary for our legitimate interests, namely to tailor the services to you.

    • We use this information to determine news, alerts and other products and services that may be of interest to you for marketing purposes. The processing is necessary for our legitimate interests, namely to inform our direct marketing.

    • We use this information to monitor and improve the services, assess the effectiveness of our advertising and/or referral campaigns, and for other internal purposes The processing is necessary for our legitimate interests, namely to improve the services generally, to monitor and resolve issues, to monitor our advertising campaigns and for other internal purposes.

  • Information about the way you access and use the Service, for example, the site from which you came and the site to which you are going when you leave our website, the pages you visit, the links you click, whether you open emails or click the links contained in emails, whether you access the Service from multiple devices, and other actions you take when using the Service.

    • ​We use this information to present the services to you on your device and to enhance and personalize your experience using the services. The processing is necessary for our legitimate interests, namely to tailor the services to you.

    • We use this information to determine news, alerts and other products and services that may be of interest to you for marketing purposes. The processing is necessary for our legitimate interests, namely to inform our direct marketing.

    • We use this information to monitor and improve the Service, assess the effectiveness of our advertising and/or referral campaigns and for other internal purposes. The processing is necessary for our legitimate interests, namely to improve the services generally, to monitor and resolve issues, to monitor our advertising campaigns and for other internal purposes.

  • Information about your location, including GPS coordinates (e.g., latitude and/or longitude) or similar information regarding the location of your mobile device, or we may be able to approximate or infer a device’s location by analyzing other information, like an IP address.

    • We use this information to present the services to you on your device and to enhance and personalize your experience using the services. The processing is necessary for our legitimate interests, namely to tailor the services to you.

    • We use this information to determine news, alerts and other products and services that may be of interest to you for marketing purposes. The processing is necessary for our legitimate interests, namely to inform our direct marketing.

    • We use this information to monitor and improve the services, and for other internal purposes. The processing is necessary for our legitimate interests, namely to improve the services generally, to monitor and resolve issues and for other internal purposes.

We may link or combine the personal information we collect about you and the information we collect automatically. This allows us to provide you with a personalised experience regardless of how you interact with us. 

 

We may anonymise and aggregate any of the personal information we collect (so that it does not directly identify you). We may use anonymised information for purposes that include testing our IT systems, research, data analysis, improving the services and developing new products and features. We may also share such anonymised information with others. You are not required to provide personal data to us, but we do rely on your personal data to provide certain of our services and products. For example, we need your personal data to facilitate the booking of a hotel. If you choose not to provide us with your personal data, we may not be able to provide you with a service or product you request.

Data Retention

We retain personal data about you for as long as is necessary for the purposes set out in these Disclosures, unless a longer period is required under applicable law or is needed to resolve disputes or protect our legal rights.

 

The criteria used to determine the period for which personal data about you will be retained varies depending on the legal basis under which we process the personal data:

  • Legitimate Interests: Where we are processing personal data based on our legitimate interests, we generally will retain such information for a reasonable period of time based on the particular interest, taking into account the fundamental interests and the rights and freedoms of data subjects

  • Consent: Where we are processing personal data based on your consent, we generally will retain the information for the period of time necessary to fulfil the underlying agreement with you, subject to your right, under certain circumstances, to have certain of your data erased (please see the Your Privacy Rights section below)

  • Contract: Where we are processing personal data based on contract, we generally will retain the information for the duration of the contract plus some additional limited period of time that is necessary to comply with law or that represents the statute of limitations for legal claims that could arise from the contractual relationship

  • Legal Obligation: Where we are processing personal data based on a legal obligation, we generally will retain the information for the period of time necessary to fulfil the legal obligation

  • Legal Claim: We may need to apply a “legal hold” that retains information beyond our typical retention period where we face threat of legal claim.  In that case, we will retain the information until the hold is removed, which typically means the claim or threat of claim has been resolved.

 

In all cases, in addition to the purposes and legal bases, we consider the amount, nature and sensitivity of the personal data, as well as the potential risk of harm from unauthorized use or disclosure of your personal data.

 

Storing and Transferring Your Personal Information

 

Security

We implement appropriate technical and organisational measures to protect your personal information against accidental or unlawful destruction, loss, change or damage. All personal information we collect will be stored by our cloud hosting provider on secure servers. We will never send you unsolicited emails or contact you by phone requesting your account ID, password, credit or debit card information or national identification numbers.

 

International Transfers of your Personal Information

The personal information we collect may be transferred to and stored in countries outside of the jurisdiction you are in where we and our third-party Service providers have operations. If you are accessing our Service from the European Economic Area ("EEA"), your personal information will be processed outside of the EEA including in the United States.

 

In the event of such a transfer, we ensure that: 

  1. the personal information is transferred to countries recognised as offering an equivalent level of protection; or 
  2. the personal information is transferred to entities certified under the EU-U.S. Privacy Shield; or 

  3. the transfer is made pursuant to appropriate safeguards, such as standard data protection clauses adopted by the European Commission.

Your Privacy Rights

You have the following rights in relation to your personal data (subject to certain limitations at law): 

  • Access: The right to access and obtain a copy of personal data about you, as well as information relating to its processing.

  • Rectification: The right to correct or update any personal data about you that is inaccurate or incomplete.

  • Restriction of Processing: The right to require us to limit the purposes for which we process your personal data if the continued processing of the personal data in this way is not justified, such as where the accuracy of the personal data is contested by you.

  • Erasure: The right to request the deletion or erasure of personal data about you without undue delay if the continued processing of that personal information is not justified.

  • Portability: The right to obtain a copy of personal data about you in an easily accessible format and the right to transmit that personal data to another controller.

  • Objection to Processing: You also have the right to object to any processing based on our legitimate interests where there are grounds relating to your particular situation. There may be compelling reasons for continuing to process your personal data, and we will assess and inform you if that is the case. You can object to marketing activities for any reason.

Please note that if the exercise of these rights limits our ability to process personal data, we may not be able to provide our products or services to you, or otherwise engage with you going forward.

 

Right to Withdraw Consent

Where we rely on your consent for processing of your personal data, you also have the right to withdraw your consent to such processing, subject to certain limitations at law.
